Terms of Use of the Application

1. General provisions

By downloading, registering and using the EVA application (the “Application”), the user confirms that they have read, understood and accept these Terms of Use.

The Application enables the search and reservation of services at restaurants, cafés-bars and other hospitality establishments.

2. User registration

Registration may be required to use certain features.

The user undertakes to provide accurate, complete and up-to-date information and is responsible for safeguarding their access credentials.

3. Reservations

  • Through the Application, the user may make reservations at hospitality establishments that are part of the platform.
  • A reservation is valid only after a confirmation is received through the Application or by email.
  • The hospitality establishment reserves the right to refuse or cancel a reservation in cases of unavailability, technical problems or other justified reasons.

4. Cancellation of organized events and refunds

If an organized event is cancelled for any reason, the funds paid by the user shall be refunded by the operator of the Application within 15 (fifteen) days from the date the reservation was made, unless otherwise provided in the terms of the specific event.

If the cancellation takes place after the expiry of the 15 (fifteen)-day period from the date of the reservation, the obligation for any refund passes to the event organizer, in accordance with their cancellation terms and refund policy.

After the expiry of the 15 (fifteen)-day period, the operator of the Application has no obligation to refund the paid funds and bears no responsibility for the organizer’s decisions regarding the refund.

Before making a reservation, the user is obliged to familiarise themselves with the cancellation and refund terms established by the event organizer.

5. User responsibilities

The user undertakes:

  • not to use the Application contrary to law;
  • that the user of the Application shall be of legal age (an adult);
  • not to enter false or fraudulent information;
  • not to carry out activities that could compromise the security of the Application.

6. Limitation of liability

The operator of the Application is not responsible for:

  • the quality of services provided by the hospitality establishments;
  • inaccurate information entered by the hospitality establishments;
  • damage arising from interruption of the internet connection or technical problems.

7. Intellectual property

All rights to the Application, the logo, the design, the content and the software belong to the operator of the Application and may not be used without prior written consent.

8. Changes to the terms

The operator has the right to amend these Terms of Use at any time. The amendments take effect upon their publication in the Application.

9. Applicable law

These Terms are governed by the laws of the Republic of North Macedonia.
